A Lawsuit is the Answer
I'm confused by this whole annexation thing. If something is annexed it should be considered part of one town, not an overlapping part of two. But not in Ohio. Some people are getting double taxed. It's one of the mysteries of Ohio. But here's what's really important; The BJ made me laugh this morning with an amusing little title: Summit would like to be sued.For perhaps the first time, Summit County officials actually hope to get sued. A lawsuit may be the only way to clean up an annexation mess that perplexes officials.
Mary Margaret Rowlands, chief deputy treasurer in the county Fiscal Office, said a lawsuit over the issue could result in a court order that might buy enough time for officials to look for a solution, or for the state legislature to act to correct the situation.[...]
Shelley Davis, chief of staff for the Fiscal Office, said her office has been instructed by the county prosecutor to begin following the Ohio attorney general's requirements to tax for both jurisdictions. Davis said her office doesn't want to go after taxpayers, but it's not being given a choice.[...]
Davis gave an example of a parcel of commercial property that was annexed in 1996 from Bath Township to Akron.
Next year, property taxes for the parcel for the city would normally be $3,235 for each half year. If taxes have to be collected for both the city and the township, the total due would be $4,089 per half -- or more than $1,700 more per year. Isn't this why we had a Revolutionary War? No Taxation Without Representation! These peeps are getting taxed from two locales, but are only being represented by one! Don't be surprised if you hear about the Bath Township/Akron Militia revolting.
